TERMS OF SERVICE

Habit Factory in Sweden AB, org. no. 559198-2375, Ostmästargränd 5, 120 40 Årsta, (“Habit Factory”, “We”, “Us”, “Our”) operates the website www.klint-allwhite.com (the “Website”). Via the Website, you can buy goods from Habit Factory. These general terms of purchase (the “Terms”) apply to all orders for goods you as a consumer complete on the Website. By completing your order, you accept and agree to abide by the Terms. Habit Factory reserves the right to make changes to the Terms at any time. Each change is published on the Website and applies from the time you have accepted the Terms through a new order or 10 days after Habit Factory has informed you of the changes (for example by subscription). The provisions in i.a. The Consumer Purchases Act (1990: 932) and the Act (2005: 59) on distance contracts and contracts outside business premises are applied to all purchases made by consumers via the Website.

As a condition of your completing an order, you accept these Terms, you hereby represent and warrant that (i) you are at least eighteen (18) years of age, (ii) all information supplied by you is true, accurate, current and complete and (iii) you possess the legal authority to enter into these Terms in accordance with all terms and conditions herein, (iv) you resides and have entered a delivery address in Sweden.

If you do not fully understand, agree and comply with these Terms, or if you are unable to enter into legally binding contracts, you may not access or us our Website. Information that Habit Factory considers to constitute a criminal proceeding, such as an order in another person’s name, will be reported to the police. In case of suspicion of irregularities or misuse of our ordering function, Habit Factory always reserves the right to refuse a purchase.

PRICING AND FEES

All prices stated on the Website are in Swedish kronor including VAT. Special fees may apply for shipping, invoice layout, partial payment and for unredeemed packages. The total cost of your order is automatically calculated based on your choices and presented before you complete the order. Any incorrectly stated prices may be corrected in connection with Habit Factory confirmation of your order to your e-mail address.

PAYMENT

Payment on the Website is made via one of our payment gateways. Through our Payment Gateways, you may be offered the payment options card payment, invoice, partial payment or direct payment through your bank. Habit Factory does not charge an extra fee for any of the payment options. Our payment providers may charge fees for the payment options, but states this in such a case in connection with the purchase.

When paying by card, the following payment cards are accepted: Mastercard and Visa.

When paying by invoice or partial payment, you need to enter certain information about yourself that is used by the provider to be able to identify you. The information you need to provide to achieve identification may vary between different purchases and customers. By leaving information at the checkout, you also accept our providers terms.

When paying by invoice or partial payment, the Payment Gateway takes a credit report, but it does not affect your creditworthiness and is not visible to others who request credit information, e.g. banks. Once you have been identified, the Payment Gateway shows which options are available to you. For invoice payment, the payment period is 14 days.

PAYMENT WITH KLARNA

In order to offer you Klarna’s payment methods, we may at the checkout share your personal information in the form of contact information and order information with Klarna, so that Klarna can assess whether you can choose the payment methods, and to adapt them for you. Your personal data that is shared is processed according to Klarna’s own data protection information.

DELIVERY

We offer different shipping options based on the order amount, size and/or your location.

Consignment note: for smaller items that can be left in the mailbox. Habit Factory reserves the right to weather conditions that make delivery to the mailbox more difficult. We also reserves the right to the dimensions of the mailbox, letter box, safety box and property box.

Package: for larger shipments that are sent to the nearest delivery point. When the package is available for collection, an SMS with information about the serial number will be sent to the mobile phone number specified when ordering. When collecting a consignment, a valid ID document must be presented.

Delivery time

Normal delivery time is 1 – 3 working days from the time we have confirmed your order via e-mail. In general, the delivery time for orders registered before 12.00 a working day, counted from the same working day. If the order is registered after 12.00 on a working day, the delivery time is instead calculated from the next working day. For orders that are registered during public holidays, the delivery time is calculated from the first working day after the end of the public holiday. In connection with your order being sent from Habit Factory, an email will be sent to the specified e-mail address. If you have not received your order after 3 working days, contact our customer service at info@klint-allwhite.com and we will help you. Should Habit Facotory for any reason not be able to deliver your order and have announced this, you have the opportunity to cancel the purchase by contacting our customer service as above.

Unredeemed packages / shipments

Packages delivered to agents will be returned to Habit Factory if they have not been picked up within 14 days of the package’s arrival being announced to you. If this happens, you will be charged a fee of SEK 299 for costs attributable to our administration, shipping, return shipping and handling. Unredeemed packages are not normally regarded as an exercise of the right of withdrawal.

Please note that Habit Factory only delivers to addresses in Sweden.

RIGHT OF WITHDRAWAL

When you as a consumer shop for goods on the internet, as a general rule, you always have a 14-day right of withdrawal according to law (2005: 59) on distance contracts and contracts outside business premises. The right of withdrawal does not apply to the purchase of oral nicotine products, as these are a perishable product with a limited shelf life.

COMPLAINTS

A product that deviates from the agreement or in another way does not correspond to the description that Habit Factory has provided, you as a consumer can complain to Habit Factory. In such a case, you are welcome to contact our customer service at info@klint-allwhite.com who will send a return slip to your address. The right to make a complaint only covers original defects (and not defects which, for example, are due to the product’s normal shelf life having passed or which have arisen due to normal wear and tear). Notice of the defect must be submitted to Habit Factory within a reasonable time from the time you discovered or should have discovered the defect and always no later than 7 days from the time you received the product. Habit Factory therefore recommends that you check the product carefully immediately upon receipt. You are responsible for the goods you return. Habit Factory therefore recommends that you package the product in such a way that it does not risk being damaged during transport. The product should, if possible, be returned unused with undamaged original packaging (for example, you should not write, tape or put stamps on the original packaging).

In order for cases concerning a transport damage to be handled in the fastest possible way, we ask you to keep the product’s packaging so that this can be inspected. In order to be able to return the product, you must also be able to prove your purchase from the Website, e.g. through the order confirmation / receipt that we sent to the e-mail address you entered in connection with your order. When we have received your return, a confirmation will be sent via e-mail. Depending on the extent of the damage, e.g. re-delivery, remedial or price reduction. Ultimately, repurchases may occur. In the event of an approved repurchase, Habit Factory will reimburse you for the cost of the item, with the exception of costs for any return shipping incurred due to the fact that you have not used the return slip. Habit Factory is responsible for claims for other compensation, in addition to the cost of the product, in accordance with what follows from the Consumer Purchase Act.

PRICES AND PRODUCT INFORMATION ON THE WEBSITE

Habit Factory strives for the information on the Website to always be correct, but reserves the right to final sales as well as any image and writing errors on the Website, such as errors in product description, incorrect price and incorrect stock status information. Habit Factory further reserves the right to correct such errors at any time and to change or update the information. All image information should be considered as illustrations and can not be guaranteed to reflect the exact appearance or nature of the product.

By submitting reviews of products on the Website, you give Habit Factory the right to publish them on the Website and in other channels and media. Habit Factory also reserves the right not to publish and / or delete submitted reviews.

FORCE MAJEURE

Habit Factory is not obliged to fulfill a purchase agreement or subscription if fulfillment is made more difficult as a result of an event outside our reasonable control (eg changed legislation, government action, strike, blockade, sabotage, war, terrorism, fire, flood, natural disaster or other extraordinary event). These circumstances release Habit Factory from the obligation to pay damages and if the circumstance has lasted longer than two months, both you and Habit Factory have the right to cancel the purchase with immediate effect.

Habit Factory follows the Swedish General Complaints Board’s (“Allmänna reklamationsnämnden”) recommendations.

Disputes between Habit Factory and a consumer can be referred to the General Complaints Board for a decision. The General Complaints Board’s address is Box 174, 101 23 Stockholm and the website’s address is www.arn.se. Ultimately, a dispute can be resolved by a general court, whereby Stockholm District Court shall be the first instance.
